1. Generalități

www.necsys.ro is a website managed by SC NECSYS SRL;

General Data Protection Regulation no. 679/2016 (hereinafter referred to as GDPR), for the protection of individuals with regard to the processing of personal data and the free movement of such data, is applicable in all European Union countries, starting from 25.05.2018. This Regulation has a significant impact in all sectors of activity, which is why NECSYS.RO (NECSYS SRL) proceeded to review the current programs, in accordance with this Regulation, so that it can identify possible impediments and implement the necessary changes in his activity.

The concept of personal data protection represents the natural person's right to have those characteristics that lead to his identification protected and the correlative obligation of the NECSYS.RO operator to adopt appropriate measures to ensure effective protection. Personal data means that information that can be directly or indirectly linked to an identified or identifiable natural person, such as, for example: name, first name, personal code, address, telephone, image, voice , economic-financial situation, bank account number, profession.

Considering the need to defend and respect the fundamental right to intimate and private life, the protection of personal data is a particularly important field, a fact confirmed by the treatment of this topic in separate chapters provided for in the Convention on the Implementation of the Schengen Agreement.

Over time, NECSYS.RO has sent various e-mails in an attempt to keep you up to date with the latest offers and with useful information related to the products in our offer. We want you to remain as well informed as possible without overwhelming yourself with unnecessary information.

In accordance with the requirements of the GDPR, in order to be able to further inform you for the purpose mentioned below, the existence of the Consent given by you is necessary. This Consent must be granted by a clear action, which shows the free, specific, informed consent and unambiguously, regarding the processing of your personal data.

2. The rights of the data subject/visitor conferred by GDPR no. 679/2016:

With the request/granting of consent, you are informed about the rights conferred by the GDPR regarding personal data, as well as about the consent expressed by you for the collection of personal data and the processing of this data by NECSYS, namely:

  • The right to revoke it at any time - revocation that will be as accessible as giving consent.
  • The right to information - the operator is obliged to inform the data subject about the processing of his personal data, upon his written request (within the limit of one request per year) sent to the operator at office@necsys.
  • The right of access to data – any data subject has the right to obtain from the operator, upon request, confirmation that his personal data is or is not being processed by him.
  • The right to access data – any data subject has the right to obtain from the operator, free of charge, the rectification, updating, blocking or deletion of data whose processing is not in accordance with the law, in particular incomplete or inaccurate data, by means of a request written to the address of the operator at office@necsys.
  • The right to object - the data subject has the right to object at any time, through a written request, dated and signed, for legitimate reasons related to his particular situation, that the data concerning him be the subject of processing , through a written request sent to office@necsys.
  • The right to transform the collected personal data into anonymous data, through a written request sent to the NECSYS operator at office@necsys.
  • The right to go to court - any person who has suffered damage as a result of an illegal processing of personal data can go to the competent court for reparation. If the persons whose personal data are processed consider that their rights provided for by the GDPR have been violated, they may apply in writing to the Supervisory Authority, provided that they have not previously filed a legal action with the same object , but only after they have previously addressed the complained operator. The complained operator has the obligation to respond to the concerned party, in writing, within 15 days of receiving the notification. The complaint to the Supervisory Authority cannot be submitted earlier than 15 days after submitting a complaint with the same content to the operator. If the complaint is found to be well-founded, within 30 days from the date of its receipt, the Supervisory Authority must communicate the decision taken to the interested parties, a decision that must be motivated. The Supervisory Authority can turn to justice to defend any rights of the persons concerned, guaranteed by law.
  • The right to be forgotten - natural persons can request the deletion of personal data if they have been processed illegally, without their consent or if the data are no longer necessary for the purpose for which they were initially processed.
  • The right to data portability – natural persons have the right to request that their personal data be transferred to another operator, in which case NECSYS can provide the personal data of the data subject to other companies with which it is in partnership, but only on the basis of a commitment of confidentiality on their part by which they guarantee that these data are kept safe, for the purposes mentioned above, and on the condition of the consent of the person concerned for this portability.
  • The right not to be subject to an individual decision made on the basis of automatic processing, the withdrawal or cancellation of any decision that produces legal effects regarding him, adopted exclusively on the basis of personal data processing, carried out by automatic means.

3. SThe purpose of collecting and processing personal data is:

  • Informing customers/potential customers about the status of their account, including validating, shipping and invoicing the ordered products, solving problems arising when issuing an order for purchased goods or services;
  • Sending newsletters and/or periodic alerts, using electronic mail (e-mail, SMS), commercial offers;
  • For market research activities, sales tracking and monitoring, as well as Customer/Visitor behavior;

4. Obligations of the operator NECSYS (SC NECSYS SRL)

According to the requirements of GDPR no. 679/2016, NECSYS has the obligation to manage the personal data you provide us in a secure manner and only for the specified purposes. At the same time, the NECSYS operator has the obligation to notify the data subject whose data has been disclosed, if this notification does not prove to be impossible or does not involve an effort disproportionate to the legitimate interest that could be harmed.

5.The consent given by the person concerned/visitor

By completing the data in the contact form and/or subscription to the newsletter, the Visitor declares and accepts unconditionally that his personal data will be included in the database of NECSYS (SC NECSYS SRL) and expresses his express and unequivocal agreement that all these personal data will be stored, used and processed for the purposes shown above, in point 3.

By reading this information, the Visitor declares that he has read, understood and agrees that the SC NECSYS SRL operator collects, stores and processes personal data, according to the requirements of Law no. 506/2004 GDPR (2016/679), also taking note of the rights conferred by these legal provisions.
